Free Wi-Fi Access
Terms & Conditions

This free Wi-Fi access service (the “Wi-Fi”) is provided to you by VF Northern Europe Services ltd, with registered offices in Park Road East, Calverton, NG14 6GD Nottingham United Kingdom (“VANS”).

These terms and conditions (“T&C”) set out the rights and obligations which apply to your use of the Wi-Fi. Please ensure you carefully read and understand these T&C.

These T&Cs are governed by English law. VANS may be required to comply with legal requirements, which may include, for example, keeping logs of online activity by individual users and/or to report users’ online activity to regulators and authorities that request such information in accordance with applicable laws and regulations. Use of the Wi-Fi for any illegal activity is expressly prohibited and may be reported to such regulators or authorities by VANS, and your identity may be disclosed for this purpose. In any event, any use of the Wi-Fi in that does not comply with these T&C is also prohibited, and we may be required to suspend or terminate your access to the WiFi services if you do not comply with these T&Cs.

Prohibited activities include: uploading audiovisual and multimedia content and materials which breach the intellectual property or other rights of third parties; making, posting, transmitting, uploading, downloading or otherwise facilitating any content that is unlawful, threatening, obscene, hateful, offensive and/or defamatory statements including through the posting of comments; submitting unsolicited e-mails, especially of a promotional and/or commercial nature; breaching the Wi-Fi’s network security or third party network or website security in any way, including, for example, by means of virus propagation, Trojans, worms, logic bombs or other material that is malicious or technically harmful; unauthorized network access, denial-of-service attacks or similar; any use of the Wi-Fi in any way that affects the ability of other customers to use it appropriately or otherwise disrupts the Wi-Fi. You assume full and exclusive responsibility for any unlawful conduct or damage caused to third parties in any way related to or resulting from your use of the Wi-Fi and you undertake to indemnify and hold harmless VANS and its officers and affiliates from any legal action brought by any third party in relation to such unlawful conduct or damage.

The wi-fi is provided “as is”, and any express or implied warranties, conditions and other terms (including conditions as to merchantability and fitness for purpose) are disclaimed and no representations or guarantees are provided. Use of the Wi-Fi is at your own risk and to the maximum extent permitted by the applicable law.
VANS is responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these T&C, we are responsible for loss or damage you suffer that is a foreseeable result of our breaching these T&C or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the T&C were agreed, both we and you knew it might happen.

Nothing in these T&C shall limit or exclude in any way any liability VANS may have for (i) death or personal injury as a result of VANS or its affiliates' negligence; (ii) fraudulent misrepresentation; or, (iii) any other matter which it would be illegal or unlawful to exclude or attempt to exclude under applicable law.

VANS does not control, nor is it in any way liable for, data or content that you access or receive via the WiFi service. You acknowledge that the Internet is inherently insecure, and understand that VANS does not provide any guarantee as to privacy or security when you use the Wi-Fi or any other Internet communications (save as set out in the VANS Privacy Notice). You are solely responsible for securing your data and equipment. You also undertake to safeguard, and not to share with any third party, any access credentials you may be provided to access the Wi-Fi, for the entire time in which they will be assigned to you. You acknowledge and accept that all the activities carried out through the Wi-Fi and ascribable to you (based on any reasonable form of association, e.g. the fact that such activities were conducted under your access credentials, or by an IP then associated to your device, etc.) will be considered as carried out by you, unless you are able to demonstrate that they have been carried out by third parties without your consent. Users are also responsible for any charges incurred as a result of using their device to access the Wi-Fi service.

VANS may from time to time make modifications or changes to the Wi-Fi service or these T&C, or decide to discontinue offering the functionality.  VANS will give reasonable notice of any material changes that it believes will adversely impact your use of the WiFi.  However, there are times when company will need to make changes to the WiFi and/or these T&C without giving notice.  These will be limited to circumstances where company needs to take action for security reasons or to comply with its legal obligations. If any provision of these T&C is found to be invalid or unenforceable, that provision will be enforced to the maximum extent possible so as to give effect to the intention of the parties, and the remainder of these T&C will continue in full force and effect. If you are dissatisfied with the Wi-Fi in any way, we recommend that you discontinue your use of the Wi-Fi.

By proceeding to use the WiFi, you acknowledge that VANS will process personal data relating to you in order to provide access to the service, to monitor and improve the service and to prevent unauthorised use of the service. Details of how and why VANS uses your personal data are set out in VANS' Privacy Policy. If you choose to use the Wi-FI service to access web sites or content provided by third parties or purchase products from third parties, then your personal data may be available to the third-party provider. The way third parties handle and use your personal information related to the use of their services is governed by their policies and VANS has no responsibility for their policies, or third parties’ compliance with them.

By completing registration and/or using of the Wi-Fi, you confirm to VANS that you are over the age of 18.
